Please take notice that the Town Board of the Town of Greenport shall hold their 2022 organizational meeting on Wednesday, January 5, 2022 at 7pm at the Greenport Town Hall, 600 Town Hall Drive, Hudson, NY.  The meeting will be preceded by a 6pm workshop meeting.
The Town will be able to accommodate in-person public attendance at this meeting with masks, however, interested parties are afforded the opportunity to present public comment in writing or orally during the public broadcast of the public hearing on line at

     The Town of Greenport will hold an End of Year Town Board meeting on Tuesday, December 28 at 11:00 a.m. preceded by a workshop meeting at 10:30 a.m. at the Greenport Town Hall, 600 Town Hall Drive, Hudson, New York.

A LOCAL LAW To Opt Out of Allowing On-Site Cannabis Consumption as Authorized Under the Marijuana Regulation and Taxation Act
 
 
BE IT ENACTED by the Town Board of the Town of Greenport (the “Town”) in the County of Columbia as follows:
 
Section 1. Title
This local law shall be known as, “A Local Law to Opt Out of Allowing On-Site Cannabis Consumption as Authorized Under The Marijuana Regulation And Taxation Act”, Local Law No. ___ of 2021 (the “Local Law”).
 
Section 2. Legislative Findings, Intent and Purpose.
It is the intent of this Local Law to opt out of allowing on-site cannabis consumption sites in the Town of Greenport that would otherwise be allowed under the Marijuana Regulation and Taxation Act (“MRTA”). The Town of Greenport is concerned with the health, safety, and welfare of its residents by permitting such on-site consumption cannabis sites and therefore it has determined it is in the best interest of the Town to opt-out. This local law does not opt the Town out of allowing cannabis retail dispensaries within the Town of Greenport.  
 
Section 3. Statement of Authority.
This Local Law is adopted pursuant to MRTA §131 which expressly authorizes the Town Board to adopt a local law requesting the Cannabis Control Board to prohibit the establishment of cannabis retail dispensary licenses and/or on-site consumption licenses within the jurisdiction of the town and is subject to a permissive referendum, the procedure of which is governed by Municipal Home Rule Law §24.
 
Section 4. Local Law Opt-Out.
The Town hereby opts out of allowing on-site cannabis consumption sites from being established and operated within the Town’s municipal boundaries.
 
Section 5. Severability.
If any clause, sentence, paragraph, section or part of this Local Law shall be adjudged by any Court of competent jurisdiction to be invalid, such judgment shall not affect, impair or invalidate the remainder thereof, but shall be confined to its operation in said clause, sentence, paragraph, section or part of this Local Law.
 
Section 6. Effective Date.
This Local Law shall take effect immediately upon filing with the Secretary of State.

     There will be a Special Town Board Meeting to conduct a Public Hearing on Monday, December 13 2021 at the Greenport Town Hall , 600 Town Hall Drive, Hudson, NY at 5 P.M. for the purpose of discussing proposed Local Law #3 titled "A Local Law to Opt Out of Allowing On-Site  Cannabis Consumptions as Autorized under the Marijuana Regulation and Taxation Act. All persons will be given an opportunity to voice their concerns and comments and may also submit written comments to the Town Clerk. The law is available to be view on the Town's website at www.townofgreenport.com or in the Town clerk's office during normal business hours.
